The Delhi government on Friday appealed to the Supreme Court, alleging that the central government is not following the constitutional bench in regard to the control over bureaucrats.
For many years, the Delhi and the federal governments have been at loggerheads over which of them controls which department and the bureaucrats therein employed.
Counsel representing the Delhi government has alleged that the supreme court delivered the judgement just yesterday (Thursday) and the federal government is now in contempt of that ruling.
Chief Justice Dhananjaya Yeshwant Chandrachud said he would assemble a bench to hear the matter next week.
After the Supreme Court verdict that the elected (Delhi) government has the power to appoint and transfer officials, the Aam Aadmi Party-led Delhi government on Thursday removed the secretary of its services department, Ashish More, and replaced him with former chief executive of the Delhi Jal Board, AK Singh.
However, it has yet to be known whether the federal government or Delhi's Lieutenant-Governor Vinai Kumar Saxena have accepted this appointment.
After the verdict, State Chief Arvind Kejriwal told reporters that officers in many posts only obstruct public work.
Kejriwal said that now such officials will “bear the consequences of their action”.
“Such posts will be identified…Either they will be left vacant, or they will be abolished. Additional posts will be created when they are required,” he added.
