Fully endorsing Attorney General R. Venkataramani's call for resolving cases through mediation, a senior advocate emphasised its potential to significantly improve the efficiency of the entire judicial system, provided the necessary framework is put in place for its effective implementation.Vivek Masih, a Delhi-based senior lawyer, told Sputnik India that the AGI knows the situation of the Indian judicial system well, and he, perhaps keeping the same in mind came up with the suggestion.He was, however, not sure if the system could be implemented in the near future. "It would take time as it's not that simple," he said, explaining the work that needs to be done before India actually decides to make the proposal a part of the country's judicial system."Economic cost, which is unbearable for many, would also come down sharply ensuring a happy society," he stressed.India's Attorney General R. Venkataramani, addressing a function in the Indian national capital a day ago, had said that the constitutional promise of access to justice for all cannot be gained through mere access to litigation and disputes must be resolved through the mode of mediation.

19:42 27.11.2023 (Updated: 20:32 27.11.2023) The proposed mode of mediation, endorsed by none other than India's Attorney General, has the potential to bring multiple benefits and expedite justice, according to an expert interviewed by Sputnik India.
Fully endorsing Attorney General R. Venkataramani's call for resolving cases through mediation, a senior advocate emphasised its potential to significantly improve the efficiency of the entire judicial system, provided the necessary framework is put in place for its effective implementation.
Vivek Masih, a Delhi-based senior lawyer, told Sputnik India that the AGI knows the situation of the Indian judicial system well, and he, perhaps keeping the same in mind came up with the suggestion. "The 'mode of mediation', if implemented with due preparation and care, would certainly help the country to decide cases in an effective and timely manner," Masih said.
He was, however, not sure if the system could be implemented in the near future. "It would take time as it's not that simple," he said, explaining the work that needs to be done before India actually decides to make the proposal a part of the country's judicial system.
On being asked if the proposed method would help in reducing the burden of the courts across the country, he said: "existing burden on the courts would also get reduced, hence improving the overall functioning of the Indian courts".
"Economic cost, which is unbearable for many, would also come down sharply ensuring a
happy society," he stressed.
India's Attorney General
R. Venkataramani, addressing a function in the Indian national capital a day ago, had said that
the constitutional promise of access to justice for all cannot be gained through mere access to litigation and disputes must be resolved through the mode of mediation."I appeal on behalf of the Indian Bar to all governments to prioritize their focus on mediation as the only lasting and economically wise system of settling issues and differences.... With the enactment of mediation law, we need to take a long jump into pushing the mediation philosophy as the major guiding force towards dispute avoidance and dispute resolution," the top law officer of India was quoted as saying by the media reports.
