High Court Acquits Accused in Nithari Murders

The CBI had filed a total of 16 cases against Surinder Koli and his employer Moninder Singh Pandher for abducting, raping and killing children and women in the Nithari area of Noida in Uttar Pradesh. On Monday, they were acquitted.
The Allahabad High Court on Monday acquitted Surinder Koli, the prime accused in the Nithari case, and co-accused Moninder Singh.
Koli was acquitted in 12 cases while Pandher was acquitted in two cases.
The bench of Justices Ashwani Kumar Mishra and Syed Aftab Husain Rizvi, while hearing the matter, said that the accused and co-accused had been acquitted due to lack of evidence.
Koli was sentenced to death in 12 cases, while Pandher was also sentenced to death by the court in two cases.
Talking to the media after the court's verdict, Manisha Bhandari, Pandher's lawyer, said: "The Allahabad High Court has acquitted Moninder Singh Pandher in the appeals against his death sentence in two cases. There were a total of six cases against him, of which he has already been acquitted in four. Koli was acquitted in all appeals against him. Now there is no case pending against Moninder Singh Pandher in the Nithari case. He will be released from jail.

All About Nithari Killings

The horrific murders of children and women in the Nithari area of Noida city in Uttar Pradesh came to light in 2006 after human remains were found in a drain near Pandher's house in the area.

Earlier, there were media reports of several children going missing from the area between 2005 and 2006. But the investigation didn't begin until May 2006, when the father of a missing girl went directly to the Senior Superintendent of Police (SSP) of Noida after the local police failed to act on his complaint.

After an initial investigation, the police arrested Koli to investigate the case further, but were unable to establish the girl's whereabouts and Koli's involvement in her disappearance.
Dissatisfied with the police investigation, the father of the missing girl approached the court in October 2006, which ordered the police to investigate the case. During their investigation, the police found some sacks containing human remains from the drain behind Pandher's house, where Koli worked as a servant.
Police arrested Pandher and Koli in December 2006 and more skeletons were found in the drain, but little evidence was found against the duo.
Later, the Uttar Pradesh state government handed over the case to the Central Bureau of Investigation (CBI) in January 2007.
The CBI also failed to find any evidence against Koli, despite him being in police custody for 60 days and a magistrate recording his confession. In his confession, Koli narrated the modus operandi and how he lured the victims, including nine girls, two boys and five adult women, into the house and murdered them.
He also confessed to attempting to have sex with the bodies, hacking them up and even eating the victims' body parts.

In 2009, a special CBI court sentenced Koli to death for the rape and murder of one of the victims. Later, a trial court also sentenced Koli and Pandher to death. However, the Allahabad High Court acquitted Pandher but upheld Koli's death sentence.

Following the Supreme Court's decision in 2010 to uphold Koli's death sentence, he decided to submit a mercy petition to the former President Pranab Mukherjee in 2014, only to have it promptly rejected.
In 2014 itself, the Supreme Court stayed Koli's execution on 8 September, four days before it was to take place. On 12 September, the stay was extended till 29 October, and later on 28 October, the Supreme Court bench headed by Chief Justice of India H L Dattu dismissed the review petition, saying there was no error in the trial court's judgment.

Three years later, in 2015, while hearing a public interest litigation (PIL) filed by an NGO, the Allahabad High Court commuted Koli's death sentence to life imprisonment, citing "inordinate delay" in deciding on his mercy petition.

Later in 2017, a special CBI court sentenced Pandher and Koli to death in connection with one of the murder cases.
In 2010, the Supreme Court also held the death sentence of Koli after which he filed a mercy petition with the then President Pranab Mukherjee who rejected it in 2014.
